Danish national man receives deferred sentence for posting nude movie clips on the social platform Reddit
A Denmark-based citizen has been convicted of sharing sexually explicit segments from protected films and television shows on the social media platform Reddit.
Based on a law enforcement document obtained by BBC News, the anonymous man shared 347 clips of explicit content in a Reddit group he moderated, which were then watched 4.2 million-plus times.
The country's police state he has been given a seven-month suspended sentence for copyright infringement.
Legal analysts say the man was prosecuted under a seldom-invoked clause in Danish intellectual property legislation, with the judge ruling that by taking the footage out of their intended setting, the accused had harmed the artists' "ethical entitlements".
He has additionally been found guilty of distributing more than 25 TB of protected data.
From spring 2022 to mid-2023, the man using the alias "the pseudonym KlammereFyr" on Reddit uploaded sexually explicit scenes including over 100 actresses.
He shared them in the subreddit he was a moderator of.
Per the Denmark's copyright protection group the Rights Alliance, his online community had more than 6,000 subscribers and participants were encouraged to request clips of specific performers.
In last year, campaigners filed the case to the authorities on behalf of the affected actors, directors and producers, which resulted in the forum being closed down.
One actress, one of the performers whose explicit content were shared in the group, told Danish media at the time she felt there was a difference between being seen unclothed in a movie and appearing on Reddit.
The performer said the posts constituted "exploitation".
'A significant message'
The man was arrested in fall 2024 and admitted guilty to the allegations recently.
In a statement after the ruling, the head of the Rights Alliance the organization's leader said the decision sent an "important" signal "that infringements of artists' rights has repercussions".
The verdict is viewed as unprecedented in Denmark for its application of the "ethical protections" section of the Danish Copyright Act, which specifies an creator's creation cannot be utilized in a manner which violates their standing.
Copyright law expert a legal scholar informed the media the legal matter was "rare" for its focus on the harm to the dignity of an performer, rather than to them financially.
The extent to which the case could influence nations abroad is uncertain.
But she said there may be "an increasing number of such cases" in the coming years with the advancement of artificial intelligence, where "the sanctity of an individual's creative output might be compromised much more easily".
